At AYA 🌺 Pacha Cacao® | Medicina Ancestral, every offering carries a journey.

Our Medicinal Cacao is created through relationships with cacao forests, farming families, Indigenous and local communities, conservation partners, and the living ecosystems of Ecuador. Many of our offerings are produced, formulated and finished in small artisanal batches rather than through conventional industrial manufacturing.

This policy has been created to provide clarity and transparency around the journey of your order—from its preparation at origin to its arrival in your hands.

By purchasing through the AYA 🌺 Pacha Cacao® online shop, you acknowledge and accept the conditions described below.

SHIPPING POLICY

1. Shipping Origins

AYA 🌺 Pacha Cacao® products originate from Ecuador, where we work with native and ancestral Cacao origins & single states, communities and regenerative Cacao-growing territories connected to our conservation mission.

Depending on your location, product availability and the nature of your order, your parcel may be dispatched directly from Ecuador or through one of our international distribution or community fulfilment points.

The shipping origin shown or communicated for an individual order may therefore vary unless directly requested a desire origin.

2. Artisanal Preparation & Processing Times

AYA 🌺 Pacha Cacao® is an artisanal Medicina Ancestral project.

Many of our cacao offerings are prepared in small batches through processes that may include selection, roasting, grinding, refining, formulation with botanicals, hand-moulding, energetic or ceremonial preparation, packaging and final quality review.

For this reason, preparation times may vary according to:

• Product and formulation selected

• Current stock availability

• Size of the order

• Seasonal cacao harvests

• Community production rhythms

• International fulfillment schedules

• Holidays and periods of increased demand

Products that are currently in stock may be dispatched considerably faster than products being freshly prepared or transported between our international fulfillment locations.

Estimated preparation or delivery dates are provided as guidance and are not guaranteed unless expressly agreed in writing.

If your order is required for a specific ceremony, event, retreat or date, please contact us before ordering whenever possible.

4. Estimated Delivery Times

Delivery times vary depending on the destination, shipping method, customs procedures and the origin from which your parcel is dispatched.

International deliveries may be affected by circumstances outside the direct control of AYA 🌺 Pacha Cacao®, including:

• Customs inspections

• Import procedures

• Courier or postal delays

• Weather and natural events

• National holidays

• Remote delivery locations

• Incorrect or incomplete delivery information

• International transportation disruptions

Any delivery estimate provided by AYA 🌺 Pacha Cacao® or a shipping provider should therefore be understood as an estimate rather than a guaranteed arrival date.

5. SHIPPING

   Shipping costs depend on factors including:

• Destination country

• Weight and dimensions of the parcel

• Shipping origin

• Courier service

• Delivery speed

• Consolidated international shipment availability

Applicable shipping charges will normally be displayed during checkout, included in the relevant product offer, or communicated before payment when a custom order is being arranged.

Shipment is included for all orders to North America and Europe.*Other regions' fees may apply; please ask for a quote.

For wholesale, Love Ambassador, Legacy Partner or other special community orders, separate shipping arrangements and conditions may apply.

CUSTOMS, DUTIES & IMPORT TAXES

International orders may be subject to customs duties, import taxes, VAT, inspection charges, brokerage fees or other costs established by the destination country.

Unless expressly stated otherwise:

• These charges are not included in the product price.

• These charges are not controlled by AYA 🌺 Pacha Cacao®.

• The recipient is responsible for complying with local import requirements and paying applicable charges.

Customers are responsible for confirming whether cacao, botanical formulations or other ordered products can legally be imported into their destination country.

If a parcel is rejected, abandoned, destroyed or returned because of unpaid customs charges, refusal to complete customs procedures, or restrictions imposed by the destination country, any refund will be assessed individually. Shipping, customs, handling and return costs may be deducted from any amount eligible for refund.

ADDRESS ACCURACY

Customers are responsible for providing a complete and accurate delivery address, recipient name, telephone number and any other information required for successful delivery.

AYA 🌺 Pacha Cacao® cannot be held responsible for delays, failed deliveries or losses resulting from incorrect or incomplete information supplied by the customer.

If a parcel must be rerouted or resent because incorrect information was provided, additional shipping charges may apply.

Please contact us as soon as possible if you discover an error in your shipping information. Once an order has been dispatched, we may no longer be able to modify the delivery details.

LOST, DELAYED OR DAMAGED SHIPMENTS

Once a parcel has been transferred to a postal or courier service, its transportation is managed by that carrier. However, when difficulties arise, we will make reasonable efforts to support the customer and communicate with the shipping provider where possible.

If your parcel:

• Arrives visibly damaged

• Contains products damaged during transportation

• Appears to be lost

• Has experienced an exceptional delay

please contact AYA 🌺 Pacha Cacao® as soon as possible.

For damaged parcels, please report the issue within 7 days of delivery whenever possible and provide:

• Your order information

• A description of the issue

• Clear photographs of the external parcel

• Clear photographs of the internal packaging

• Clear photographs of the affected product

• A photograph of the shipping label

Please retain all original packaging while the case is being reviewed.

Claims submitted significantly after delivery may be more difficult or impossible to process with the relevant carrier.

RETURNS & QUALITY POLICY

1. Our Quality Commitment

AYA 🌺 Pacha Cacao® is committed to offering cacao and botanical preparations created with attention to:

• Ingredient integrity

• Traceability of origin

• Artisanal craftsmanship

• Responsible sourcing

• Conscious handling

• Ecological regeneration

• Respect for ancestral knowledge and cacao traditions

Our products are made with natural agricultural ingredients and may therefore present variations between batches.

Differences in colour, aroma, texture, surface appearance, botanical distribution or flavour are not necessarily indications of a quality defect.

Natural cacao may also respond to changes in temperature during transportation. Cosmetic changes caused by temperature fluctuations, including cacao butter bloom, do not automatically mean that the product is unsafe or spoiled.

2. Food Products and Returns

For reasons of hygiene, food safety and product integrity, we generally cannot accept returns of cacao or other consumable products that have been:

• Opened

• Used

• Partially consumed

• Removed from their original sealed packaging

Please inspect your order shortly after receiving it.

Nothing in this policy is intended to limit any mandatory consumer rights that may apply under the laws of your country.

3. Cases Eligible for Review

A refund, replacement or store credit may be considered when:

• The wrong product was sent

• An incorrect quantity was supplied

• The product was significantly damaged during transportation

• A verified quality or food-safety issue was present when the product arrived

• An item included in the confirmed order was missing

Each request is reviewed individually based on the circumstances and evidence provided.

Natural differences inherent to handcrafted cacao and botanical products are not generally considered product defects.

4. Reporting a Product Issue

If you believe there is a problem with your order, please contact us within 7 days of receiving your parcel whenever possible.

Please provide:

• Your name

• Order number or proof of purchase

• A clear description of the issue

• Photographs of the product

• Photographs of the packaging

• A photograph of the shipping label when the issue may relate to transportation

Please do not dispose of the affected product or packaging until we have reviewed your request.

Providing this information allows us to understand what happened, improve our processes and, when applicable, submit a claim to the shipping provider.

5. Refunds

When a refund is approved:

• The refund will normally be issued through the original payment method where technically possible.

• Bank or payment-provider processing times may vary.

• Original shipping charges are generally non-refundable unless the issue resulted directly from an error by AYA 🌺 Pacha Cacao®.

• Customs duties, taxes and third-party handling charges are generally non-refundable by AYA 🌺 Pacha Cacao®.

Where the original payment method cannot reasonably be used, another mutually agreed solution may be offered.

6. Replacements and Store Credit

Depending on the circumstances, availability and destination, an approved resolution may include:

• Replacement of the affected product

• Partial refund

• Full refund

• Store credit

• Another mutually agreed solution

Replacement products remain subject to artisanal production schedules, stock availability and international shipping conditions.

ORDER CANCELLATIONS

Because some AYA 🌺 Pacha offerings are prepared, formulated or allocated specifically for an order, cancellation may not always be possible once preparation or fulfillment has begun.

If you need to cancel an order, contact us as soon as possible.

Where an order has already been prepared, personalized, dispatched or committed to production, cancellation or a full refund may not be available, subject always to applicable consumer law.

MEDICINAL CACAO & WELLNESS DISCLAIMER

The term “Medicinal Cacao” or “Medicina Ancestral” reflects the ancestral, nutritional, botanical, cultural and intentional framework through which AYA 🌺 Pacha works with cacao.

Our products, educational materials and traditional or ceremonial descriptions are not intended to diagnose, treat, cure or prevent disease and are not a substitute for individualized medical care.

Customers are responsible for determining whether a product and its ingredients are appropriate for their individual circumstances, particularly in cases involving pregnancy, breastfeeding, allergies, sensitivities, medical conditions or medication use.

Ingredient information should be reviewed before consumption.

AYA 🌺 Pacha Cacao®, AYA 🌺 Pacha Academy®, associated product names, formulations, educational methodologies, written materials, visual identity, original artwork and other proprietary content may be protected by trademark, copyright or other intellectual property rights.

No purchase grants permission to reproduce, commercially use, imitate, distribute or represent AYA 🌺 Pacha intellectual property without prior written authorization.

References to ancestral traditions or knowledge do not constitute a claim of ownership by AYA 🌺 Pacha over the collective cultural heritage of Indigenous peoples or ancestral communities.
